Delay & Disruption Analysis in Construction Claims: Methods and Evidence Standards

Quantifying delay and disruption is among the most contested areas of construction disputes. Rigorous methodology from the outset determines the strength of any claim.

Delay and disruption claims are among the most complex and frequently contested matters in construction disputes. The financial stakes are high, the factual record is almost always incomplete, and the methodologies available to quantify the claimed entitlement are varied and frequently misapplied. Getting the analysis right — from the earliest stages of the project — is what distinguishes a recoverable claim from an expensive exercise in litigation with an uncertain outcome.

Delay and Disruption: A Critical Distinction

Before any quantification work begins, it is essential to understand the difference between delay and disruption. These are related but distinct concepts, and they give rise to different legal entitlements and require different quantification approaches.

Delay is a failure to complete the works, or a portion of the works, by the contracted completion date or a key milestone. Delay claims are primarily about time — the contractor seeks an extension of time to avoid liquidated damages, and may also seek to recover prolongation costs for the extended period.

Disruption is an interference with the efficiency with which the works are carried out. A disruption event need not cause delay to overall completion — it may simply cause the contractor to incur additional cost to achieve the same programme by working less efficiently or deploying additional resources. Disruption claims are primarily about cost rather than time.

Many claims conflate the two, which creates analytical confusion and weakens the overall claim. A rigorous analysis treats delay and disruption separately, applies the appropriate methodology to each, and clearly establishes the causal nexus between the employer event and the claimed entitlement.

Delay Analysis Methods

Several recognised methodologies exist for delay analysis. Each has advantages and limitations, and the appropriate choice depends on the quality of the available programme records, the nature of the delay events, and the requirements of the applicable contract and governing law.

As-planned versus as-built. The simplest approach: compare the planned programme with the as-built sequence and calculate the overall slippage. This method has the advantage of simplicity but significant limitations — it does not identify causation, does not account for concurrent delay, and provides no basis for allocating delay between the parties. It is rarely sufficient as the sole methodology in a contested claim.

Impacted as-planned. The baseline programme is impacted with the delay events to demonstrate the theoretical effect on completion. This method is forward-looking and based on planning assumptions rather than actual events. It can be useful as a supplementary analysis but is frequently challenged because it ignores what actually happened.

Time impact analysis (TIA). A prospective method that inserts each delay event into the programme at the time it occurred and measures the contemporaneous impact. TIA is regarded as one of the most reliable methodologies because it reflects the state of the works at the time of each event and captures the dynamic interaction between concurrent activities. It requires good-quality contemporaneous programme records.

Collapsed as-built (but-for analysis). The as-built programme is taken and the delay events are removed to produce a "but-for" programme showing when the works would have completed without the events. This retrospective method is intuitive but requires careful application to avoid double-counting and to properly handle concurrent delay.

Windows analysis. The project is divided into discrete time windows, and the delay within each window is analysed using one of the above methods. This approach handles complex, overlapping delay events better than a whole-of-project analysis and is well suited to large projects with a complex chronology.

Evidence Standards

The quality of the evidence base is the single most important determinant of whether a delay claim can be successfully pursued or defended. A technically sophisticated analysis built on poor-quality underlying data will not withstand scrutiny in adjudication or arbitration.

The key categories of evidence in a delay claim are:

  • Contemporary programmes. The baseline programme and all subsequent programme revisions, ideally in native software format with activity relationships and resource allocations intact. Logic-only programmes without resource loading are of limited analytical value.
  • Progress records. Site diaries, weekly progress reports, inspection records, and photographic evidence that establish what work was actually carried out and when. Gaps in the contemporaneous record significantly weaken the evidentiary position.
  • Instructions and correspondence. All instructions, variation orders, RFIs, drawing issue registers, and correspondence that document the events giving rise to the claim. The causal chain from employer event to programme impact must be demonstrable from the documentary record.
  • Resource records. Labour allocation sheets, plant records, and subcontractor attendances that support both the delay analysis and any disruption quantification.
  • Cost records. Valuations, payment applications, daywork sheets, and subcontractor accounts that provide the financial basis for the prolongation and disruption costs claimed.

Concurrent Delay

Concurrent delay — where contractor-caused delay and employer-caused delay operate simultaneously — is one of the most contested issues in construction disputes. The English courts have developed a body of case law on this issue that can significantly affect the contractor's entitlement to an extension of time and recovery of prolongation costs.

The general position under English law is that a contractor is entitled to an extension of time where there is concurrent delay, but may not recover prolongation costs for the period of concurrency unless the contract expressly provides for this. This asymmetry has significant implications for the quantum of any claim and must be properly addressed in the analysis.

The identification and quantification of concurrent delay requires careful analysis of the programme logic and progress records. It is not sufficient to assert that employer delay and contractor delay were occurring simultaneously — the analysis must demonstrate the effect of each on the critical path.

Building the Record from Day One

The most common mistake made on projects that subsequently give rise to disputes is the failure to build and maintain the evidentiary record throughout the project. By the time a claim is being prepared, the contemporaneous evidence is incomplete, witnesses have moved on, and programme records are inconsistent with the as-built facts.

Contractors who maintain rigorous programme records, issue timely notices of delay, document disruption events as they occur, and preserve their cost records in a format that supports future analysis are consistently better positioned in disputes than those who attempt to reconstruct the position retrospectively.

This is not a counsel of cynicism — it is sound project management practice. The disciplines that produce a strong evidentiary record in a dispute are the same disciplines that produce good project management: regular programme updates, accurate progress reporting, systematic documentation of instructions and changes, and timely escalation of issues.

The Role of the Independent Expert

In contested delay claims, both parties will typically appoint independent delay analysts and quantum experts. The function of the independent expert is to apply rigorous methodology to the available evidence and to express an objective view of the claimed entitlement. An expert who overstates the entitlement or advocates for their client's position beyond what the evidence supports will not be effective — and may actively harm the claim.

The most effective delay experts are those who have direct construction experience, understand the practical realities of complex project delivery, and are able to explain technical methodologies to non-technical decision-makers in adjudication, arbitration, or litigation. The methodology is the foundation; the expert's judgment and credibility are what carry the analysis.
